Terms of Use for Expense Manager
Version 1. Effective from October 17, 2026.
These terms are the agreement between you and Abel Alciviades Rojas Bernal (Artecpy), based in Horqueta, Paraguay ("we"), for using the Expense Manager app (in Spanish, Gestor de gastos; Google Play ID: com.artecpy.expenses). They include our disclaimer and the limits of our liability. Please read them together with the Privacy Policy.
1. Acceptance
The first time you open the app, we show you these terms and the Privacy Policy, which you can read before deciding. By tapping "Accept", you accept these terms. If you don't accept them, don't use the app; you can leave without accepting and uninstall it at any time.
The agreement is concluded in the language in which you accept these terms. They are available in English and Spanish; if the two differ, section 13 applies. We don't keep a copy of your acceptance: the app records on your phone the version you accepted and the date.
You can read them again at any time in Settings > Privacy and terms and at https://apps.artecpy.com/gastos/condiciones, where each version remains published so that you can save or print it.
2. What the app is
Expense Manager is a tool to record income and expenses by category, keep track of recurring bills and budgets, see summaries and export reports. It works without an internet connection and stores data on your phone, not on our servers. Today it is free and has no ads or in-app purchases. It shows transactions and reports for the last 12 months; older records aren't deleted: they stay on your phone and in your backups.
3. Who can use it
The app is meant for the personal or household use of people aged 18 or over. If the age of majority where you live is higher (for example, 19 in South Korea and in some US states and Canadian provinces), you need permission from your parent or guardian.
4. License
We give you a personal, free, non-exclusive and non-transferable license to use the app on the devices you control, under these terms. The app, its code, its design and its name are ours. What you record in it is yours.
You may not:
- copy, modify or distribute the app, or publish modified versions;
- decompile it or try to obtain its source code;
- use it for anything illegal.
This doesn't prevent you from doing what the law allows you to do even if these terms say otherwise, such as the copies needed to use the app or to keep a backup copy, or decompiling it where the law permits.
If you send us ideas or suggestions, we may use them to improve the app without owing you anything for them.
5. Not advice
The app does calculations with the data you enter. It doesn't give financial, accounting, tax or legal advice, and it doesn't recommend financial products or investments. The decisions you make with that information are yours. For important decisions, consult a professional.
Results depend on what you enter: amounts, dates, currency and categories. Check that this data is correct.
6. Your data and your phone
- What you record. You are responsible for what you enter. If you record data about other people, such as the name of someone who owes you money, do it only for your personal use and take care of that information.
- Backups. Your data is stored on your phone, and we don't have any copy of it. If you lose or change your phone, clear the app's data or uninstall it without a backup, you may lose it. Make backups often from Settings > Backup and keep them in a safe place. Android backup also helps, but it depends on your settings and on Google.
- Phone security. Protect access to your phone: use a screen lock, keep in mind who uses it and check what the widget and notifications show. Backups and reports you save or share, and the cloud services you choose to store them, are under your control.
This section doesn't change our liability for faults in the app, which is governed by section 9.
7. Reminders
Reminders depend on Android. The system may delay them or not show them, for example because of battery saving, the manufacturer's settings, disabled permissions or the phone being off. They are an aid: they don't replace your own tracking of dates and due dates.
8. How the app is provided
We do our best for the app to work well, but we can't promise that it is free of errors or that it works on every phone.
We may update the app to fix errors, improve security or performance, adapt it to new versions of Android or to changes in the law, or add features, and we may stop offering it on Google Play. While the app is free, we don't commit to providing technical support or publishing updates. Except under new terms that you accept (section 10), an update doesn't charge you for what is free today or remove from the app what section 2 describes. Google Play installs updates according to your settings. If we stop offering the app, the one you already installed doesn't stop working because of that, and as long as it works you can save your data with a backup.
This doesn't affect the guarantees that the law of the place where you live gives you and that can't be excluded.
9. Liability
9.1. We are liable without limitation:
- for intent (when we cause harm on purpose) and for gross negligence, whether ours or that of the people acting for us;
- for injury to life, body or health;
- under laws on liability for defective or unsafe products or services;
- in any other case where the law of the place where you live doesn't allow liability towards consumers to be limited.
Sections 9.2 and 9.3 don't apply where the law of the place where you live doesn't allow them; for example, in the European Union except Germany, the United Kingdom, Australia, Quebec (Canada), Brazil, Mexico, Japan, South Korea, Taiwan, the United Arab Emirates and, if you pay for the app or a subscription, Paraguay. In those cases we are liable as the law provides.
9.2. If we cause harm through slight negligence, we are only liable if we breach an essential obligation, meaning one without which you couldn't use the app as described in these terms and whose fulfillment you rely on. In that case, we are only liable for the typical damage that could be foreseen when you accepted these terms.
Section 9.3 doesn't apply in Quebec or in the other places where section 9.2 doesn't apply.
9.3. Outside the case in section 9.2, we are not liable for damage caused by slight negligence.
9.4. If you lose data, whether you could have recovered it from a backup is taken into account when assessing the damage.
9.5. We are not liable for what third-party services you choose do, such as Google Drive or WhatsApp, or for failures of your phone or of Android that we didn't cause. This doesn't limit section 9.1.
9.6. The app is meant for personal or household use (section 3). If you nevertheless use it for a professional or business activity, we are not liable for lost profits or other indirect damage, except in the cases in section 9.1.
10. Changes to these terms
We may change these terms for valid reasons: changes in the law, new features (for example, ads or a paid version), or to fix errors or clarify the text. The new version arrives with an app update and only applies once you accept it in the app. If you don't accept it, you can save your data with a backup and stop using the app. Changes don't apply to past events.
11. If the app changes hands
If the app passes to another person or company (for example, if we publish it from a business account), these terms and the Privacy Policy remain valid with the new provider, who will tell you in the app. Your rights don't decrease because of that change.
12. Governing law and claims
These terms are governed by the laws of the Republic of Paraguay, unless you use the app as a consumer and live in Spain: in that case they are governed by Spanish law. If you use the app as a consumer and live in another country, the choice of Paraguayan law doesn't take away the protection of the mandatory rules of the place where you live, and if the law of that place doesn't allow another law to be chosen, the law of that place applies.
If you use the app as a consumer, you can bring a claim before the courts of the city of Asunción or before those of your place of residence, as allowed by the law of the place where you live. If you don't use the app as a consumer, claims are brought before the courts of the city of Asunción. We don't require arbitration.
Before bringing a claim, you can write to us at artecpy.apps@gmail.com, and we will try to resolve it. You don't have to.
13. Other provisions
- If a clause isn't valid, the rest remains in force, and the law applies in place of that clause.
- Downloading the app from Google Play is governed by Google Play's terms, which you accepted with Google. Those terms aren't part of this agreement.
- Translations of these terms may not be exact. If they differ, the interpretation most favorable to you applies, except in the United States, where the English version prevails.
- When these terms refer to the law of the place where you live, they mean the law of your country and, where applicable, of your state or province.
14. Notices for some countries
- European Union, United Kingdom and Switzerland. You keep all the rights that the consumer protection rules of your country give you, including statutory guarantees and product liability.
- Australia. Nothing in these terms excludes, restricts or modifies the consumer guarantees or the other rights you have under the Australian Consumer Law.
- United States. DISCLAIMER OF WARRANTIES. The app is provided "as is" and "as available". To the extent permitted by the law of your state, we disclaim implied warranties, including those of merchantability, fitness for a particular purpose and non-infringement. This doesn't limit section 9.1. If you live in New Jersey, all sections of these terms apply to you, including sections 9.2 and 9.3 and the limitation of liability below.
- United States and Canada, except Quebec: limitation of liability. To the extent permitted by the law of the place where you live, and except as provided in section 9.1, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, and our total liability to you for all claims relating to the app is limited to the greater of USD 50 or the amount you paid us in the 12 months before the claim.
